Terms and Conditions

The general terms and conditions form the basis for business transactions between Ute Fiege Immobilien for the fulfillment of brokerage orders, corresponding sales services and ancillary services, as well as activities within the scope of property management, WEG administration and / or rental management. In accordance with the German Commercial Code (HGB), the terms and conditions for merchants also apply to future business relationships without the need for a new agreement.

Brokerage orders in this sense are evidence of the opportunity to conclude a contract, naming one or more possible interested parties or properties with regard to a specific contract conclusion and / or the preparation of a contract conclusion with one or more interested parties.
A corresponding brokerage order comes into effect when corresponding offers from the broker are used and, as a result, contact is made with the broker or the owner and a contract is concluded. Excluded from this are brokerage services within the meaning of §2 of the Law on the Regulation of Apartment Brokerage.

Further sales services are support services in sales without actual preparation of a contract conclusion in the sense of a brokerage activity, such as advertising, initial contact and sales of rental apartments as part of a rental management.

Ancillary services are further services, such as the examination of invoices, the preparation and redesign of sales objects, valuation of real estate at market value, etc.

Dual activity
Unless this contradicts existing orders, Ute Fiege Immobilien is free to provide further services for contractual partners of a client. In the event of a later conflict of interest, the broker will inform all affected service recipients and does not require the consent of a client for this.

Deviating transaction
The claim for commission is not affected by the fact that a different transaction comes about instead of the originally intended transaction (e.g. purchase instead of rent, rent-to-own instead of purchase, lease instead of purchase, etc.), provided that the economic success does not deviate significantly from the originally intended transaction.
Confidentiality / Disclosure of offer data and information
The offers provided by Ute Fiege Immobilien, in particular exposés, and information, in total, but also their contents and parts thereof, are exclusively intended for the recipient, unless otherwise stated. The transfer to third parties by the transferring party requires written permission, without which the transfer is prohibited. If a contract is concluded due to the unauthorized dissemination, the recipient undertakes to pay the stated commission in the original amount plus VAT. Further claims due to damage to third parties, for example due to violations of data protection, are not excluded by this.

Prior knowledge
If a prospective customer is already familiar with an object offered by Ute Fiege Immobilien, they must inform the real estate agency of the existing prior knowledge within three days. If this does not happen, the prospective customer must reimburse the broker for all expenses incurred as a result of the prospective customer not informing them of the existing prior knowledge as part of the compensation for damages.

Limitation of liability
The information on the objects (exposés, all information/documents etc.) issued by Ute Fiege Immobilien comes from the owner or landlord. No liability can be assumed with regard to size, quality and condition. Ute Fiege Immobilien is only liable in the event of gross negligence, a missing guaranteed specific characteristic, intent and culpable violation of a cardinal obligation. It is the customer’s responsibility to check the information for accuracy and completeness.

Data protection
The client expressly agrees that Ute Fiege Immobilien is entitled to store and process all permissible specific personal data. This applies in compliance with the statutory regulations and in relation to the data protection declaration provided.

Place of jurisdiction
For a merchant within the meaning of the German Commercial Code (HGB), the place of jurisdiction is agreed to be Offenbach

Severability clause:
Should individual provisions of this contract be ineffective or incomplete, this shall not affect the effectiveness of the remaining provisions. The ineffective or incomplete provision shall be replaced by a provision that comes as close as possible to the economic interests of the contracting parties and does not otherwise conflict with the contractual agreements.
